Marketplace Model

Zwaap Ex operates as an intermediary marketplace aggregator. All products listed on the platform are offered by independent third-party vendors. Vendors are solely responsible for product quality, authenticity, pricing, and fulfilment. Zwaap Ex does not manufacture or directly sell any products listed on the platform.

Order Acceptance

An order is considered accepted only after an official order confirmation is issued by Zwaap Ex. We reserve the right to refuse, cancel, or limit any order at our discretion, including but not limited to cases of pricing inaccuracies, stock unavailability, technical errors, or suspected fraudulent activity.

Pricing & Errors

We strive to ensure accurate pricing and product information on the platform. However, in the event of a clear pricing or listing error, Zwaap Ex reserves the right to cancel the affected order and inform the customer accordingly. Any applicable refunds will be processed as per our refund policy.

Limitation of Liability

To the maximum extent permitted under applicable law, Zwaap Ex shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from the use of the platform, vendor products, or third-party services.

Zwaap Ex’s total liability for any direct damages shall be limited to the total value of the order placed by the customer.

Indemnity

Users and vendors agree to indemnify, defend, and hold harmless Zwaap Ex, its directors, officers, and affiliates from any claims, losses, liabilities, or expenses arising out of misuse of the platform, violation of these Terms, or any unlawful activity.

Intellectual Property

All content available on the Zwaap Ex platform, including text, graphics, logos, and software, is owned by or licensed to Zwaap Ex and is protected by applicable intellectual property laws.

Vendors grant Zwaap Ex a non-exclusive, royalty-free license to use product images, descriptions, and related content solely for listing, marketing, and promoting products on the marketplace.

Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Andhra Pradesh, India.

Changes to These Terms
